This is a question we are asked time and time again in various different ways. Military personnel, both serving and retired, tell us that they feel a little uncomfortable or uneasy bringing a claim as, as they often put it, they fully expected to be exposed to gun fire and other loud noises when they signed up so it doesn’t feel ‘right’ claiming compensation for their hearing loss and tinnitus.

You however DID NOT sign up to be treated negligently. That is exactly what has happened.

You are right in saying that certain noise exposure simply could not be avoided. Things like combat. Situations such as combat exposure are excluded from your case, after all there is no way that you could have been expected to have worn hearing protection when in contact with the enemy. We most certainly are NOT holding the MOD account for this kind of damage.

What about on the firing range? Or during exercises? Or perhaps in engine room, on flight decks or when travelling in noisy vehicles? That is where the MOD have let you down and that is why you are entitled to claim compensation. In situations such as these the MOD could have and should have provided you with the correct hearing protection and enforced its use – but time after time they simply did not do so.

The MOD is not paying out these awards as some kind of a ‘thank you’ for your service, they are doing so because they know that they failed to protect your hearing in the way that they should have and as such it is their fault that you have ended up with hearing loss and/or tinnitus that maybe could have been prevented. Proving negligence in a legal context is rarely easy, if the MOD believed that they could defend these cases then they would do so, they would have little hesitation in stopping you claiming if they could – you too should have little hesitation in bringing a claim to get the financial compensation you deserve.
