A recycling company has appeared in court after one of its workers suffered arm injuries whilst carrying out work on a piece of machinery.

The worker, an employee of Street Fuel Limited, based in Gillingham, was trying to fix a problem with the firm’s baler machine when the incident occurred in January 2014. He was situated at the rear of the machine and checking the needle, but the machine did not have sufficient guarding in place, so when the worker put his hand through a gap in the machine, the machine bed moved forward, trapping his arm.

Medway Magistrates Court heard that workers regularly put their hands through gaps in the guarding of the machine because it saved time in turning it off. The firm pleaded guilty to breaching Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998 and was fined £5,000 along with £893 in costs and a victim surcharge of £120.
