Russell Worth is backing a new campaign launched by The Association of Personal Injury Lawyers (APIL) which is calling for a change in the law for the families of those killed in England and Wales.
‘Fairness 4 Families’ is calling for the Government to review current laws surrounding the payment of bereavement damages in England and Wales, after a recent report from the APIL showed that people can potentially secure more in damages for a thumb injury than a bereavement.
Many families in England and Wales have been affected as a result of fatal accidents at work, on the road, medical negligence or industrial disease. The impact leaves many struggling to cope mentally, physically and financially. Whilst no amount of money could ever fill the harrowing void of losing a loved one, bereavement claims serve to financially and mentally support families mourning the loss a loved one. Some families may have been left unable to pay their bills after the loss of the major income earner in the family or need practical support for their trauma and suffering.
As it stands currently, however, bereavement damages can be paid only to a husband, wife or registered civil partner, meaning there is a vast injustice for those who are not married. The APIL is calling for this to change and follow in the steps of Scotland, where there is more flexibility and there is a system which looks at each case individually.
