A high percentage of the injury claims we are asked to investigate end up coming down to one thing and one thing alone, faulty or defective equipment. ‘Equipment’ is a very broad term and can refer to just about anything you use as part of your job ranging from JCB earth excavators right the way down the plain old pair of scissors.

Think about the job you do for a minute or two and try to think of all of the tools, devices, aides, machines, products and other pieces of equipment you use on a daily basis – often we don’t realise just how much equipment, and just what could happen if it were to go wrong, we rely upon every single day until we stop and actually give it some thought.

Remember faulty equipment doesn’t actually mean that the item in question isn’t working, it means that it isn’t working properly or as it should do. To illustrate by way of an example, take something as simple as a door in a department store or other large shop. Most such doors are fitted with devices to stop them from slamming shut by slowing down the rate at which they close when you let go of them. If this anti slam device fails and as a result you get your hand caught in the door then you may be able to claim against the store as their equipment was faulty even though the door itself is still in working order i.e you can still go in and out of it.

The same principle applies in your workplace, if a piece of equipment is still being used but it isn’t operating as it should you may have a claim if it causes an injury.

Sadly we read stories all too often in the press about the most serious examples of faulty equipment such as guards failing to protect the operators of industrial machines or brakes failing on vehicles and the worst part about it is that a lot of the time such injuries could have been avoided.
